This site is owned and operated by AmberWave Communications, LLC (AmberWave). The information contained in this site is proprietary to AmberWave and the modification and/or use of the materials is a violation of AmberWave’s proprietary rights.

Unless specifically permitted by AmberWave or as part of the permissions granted to use marketing collateral as an authorized FirstBackup Partner, the materials may not be used, reproduced or disclosed to others. AmberWave does not warrant the correctness or accuracy of the content contained herein.

Like all Web services, the FirstBackup online backup service may be temporarily unavailable from time to time due to required maintenance, telecommunications interruptions, or other disruptions. Although AmberWave makes every reasonable effort to minimize such downtime, AmberWave does not guarantee 100% availability of FirstBackup services. AmberWave will not be liable for any damages due to causes beyond its reasonable control, including but not limited to: acts of God, fire, war, natural disaster, accident, riots, acts of government, shortage of materials or supplies, failure of any transportation or communication system, non-performance of any of the Subscriber's agents or third party providers (including, without limitation, the failure or performance of common carriers, interchanged carriers, local exchange carriers, internet service providers, suppliers, subcontractors) or any other cause beyond its reasonable control.

The liability of AmberWave to the Subscriber for damage to or loss of data shall be limited as described in the FirstBackup Software License and Subscription Service Agreement. Under no circumstances will AmberWave be liable for the contents or value of the Subscriber's lost or damaged data.

Subscriber warrants that it is the owner or legal custodian of the data transmitted to AmberWave via the FirstBackup service and that it has full authority to transmit said data and direct its restored data at its designated computer.
